The controversy that Rabbi David Friedman withdrew from its publication after R.I.M. Pines added an introduction to the book without his knowledge

"To clarify the issues of the boycott, its foundation, power and judgment, and the judgment of those who have the power to use it, and the conditions of its use." By the genius of the generation, Rabbi David Friedman of Karlin. It was written around the announcing of the Cheremt by the zealous rabbis in Jerusalem on Rabbi Yechiel Michel Pines, one of the fathers of religious Zionism, who was Rabbi Friedman's brother-in-law.

Amid the storm of polemics there were fanatics who burned the copies of the book in front of us. The remaining copies are rare.

Printed in Jerusalem in the year 1881. At the beginning of the book is an introduction by Rabbi Pines himself.

historical background:

After Rabbi Yechiel Michel Pines supported the orphanage of Dr. Ze'ev Wilhelm Herzberg, where they taught foreign languages, contrary to the Cherem against teaching foreign languages in Jerusalem, the Jerusalem fanatics launched a Cherem against him. About a year later, when Rabbi Pines established an institution that combined craft and Torah studies, a second Cherem was issued against him, and this time Mahari"l Diskin himself participated in imposing the Cherem.

But most of the rabbis of Jerusalem did not accept the Cherem, and the rabbi of Jerusalem, Rabbi Shmuel Salant, came out criticizing the Cherem and claimed that the zealots incited Rabbi Diskin. Finally, Rabbi Salant presided over a court that permitted the Cherem of Rabbi Pines.

The year of printing was not written on the cover of the book. On the back of the cover the year 1830 is mentioned, and on the cover is written a warning "שלא להשיג שום א' מישראל את גבולי עד שנת תקצ"ח להדפיס הספר הנ"ל, הן בתבנית זה הן בתבנית אחר".

On the cover of the book are the stamps of Rabbi Aryeh Leib Salzman from Jerusalem, and additional stamps in Hebrew.

On the back of the cover is a faded ownership record: "זה הספר שייך לר' מרדכי[?]...במ"ה שלמה, מילידי עיר... לק"ק באליסטוק[?] אשר קנה בכסף מלא... ".

Throughout the book there are handwritten glosses, unfortunately most of them have faded, but a minority of them are legible.

"לבאר ענייני החרם יסודו וכוחו ומשפטו, ומשפט מי שהכוח בידם להשתמש בו, ותנאי שימושו". מאת גאון הדור רבי דוד פרידמן מקרלין. נכתב סביב פרשת הכרזת החרם של הרבנים הקנאים בירושלים על הרב יחיאל מיכל פינס זצ"ל, מאבות הציונות הדתית, שהיה גיסו של ר"ד פרידמן.

בתוך סערת הפולמוס היו קנאים ששרפו את עותקי הספר שלפנינו. העותקים שנותרו הנם נדירים.

נדפס בירושלים בשנת "לא יקום חרם ונדוי במחניך" לפ"ק = תרמ"א [1881]. בפתח הספר הקדמה מאת הרב פינס עצמו.

רקע היסטורי:

לאחר שרי"מ פינס תמך בבית היתומים של ד"ר זאב וילהלם הרצברג, בו לימדו שפות זרות, בניגוד לחרם שלא ללמד שפות זרות בירושלים, הוציאו קנאי ירושלים חרם כנגדו. כשנה לאחר מכן, כאשר הקים הרב פינס מוסד ששילב לימודי מלאכה ותורה הוצא כנגדו חרם שני, והפעם המהרי"ל דיסקין השתתף בעצמו בהטלת החרם.

אך רוב רבני ירושלים לא קבלו את החרם, ורבה של ירושלים, רבי שמואל סלנט, יצא בביקורת על מטילי החרם וטען שהקנאים הסיתו את הרב דיסקין. לבסוף, הרב סלנט עמד בראש בית-דין שהתיר את החרם על הרב פינס, בטענה ”שלא נתקבל האיסור הזה ולא פשט איסורו ולא נתבטלה אפילו תפילה אחת (לפי הנשמע) מאותו יום שנעשה האיסור עד היום... וגם אנשי חו"ל וכמה רבנים גדולי הדור וגבירים ראשי קהילות ישראל צועקים ככרוכיא על הדבר הזה...” (מלשון "נוסח ההיתר".)

לאורך הספר הגהות בכתב יד, רובן דהו לצערנו, אך מיעוטן ניתן לקריאה.
