The auctioneer's liability for any obvious or hidden defects, for loss or damage to the auctioned item is expressly excluded unless statutory liability is mandatory. Claims for damages against the auctioneer due to legal and material defects and for other legal reasons, including reimbursement of wasted expenses and reimbursement of expert costs, are excluded unless they are based on intentional or grossly negligent actions on the part of the auctioneer or are caused by injury to life, body or health. Liability for simple negligence is limited to the amount of the respective knockdown. Liability only exists for simple negligent behavior on the part of the auctioneer and the persons he is responsible for if this involves the violation of essential contractual obligations.
