TERMS & CONDITIONS
1. This Auction is organized by MNM Numis®, a registered trademark owned by ABREU & ÁVILA, LDA, NIPC 518 494 586, with registered office at Av. Julio Dinis, n. 6 A/D, Loja 22. Centro Comercial Julio Dinis, 1069-215 Lisboa, Portugal.
2. The Goods in this Auction are the property of MNM Numis®, and a purchase and sale contract is established between the winning bidders and MNM Numis®.
3. This auction is governed by EU rules on online purchases, and the rules of Consumer Law (Law no. 24/96, of July 31 and Decree-Law no. 24/2014, of February 14) apply, in particular:
a) The quality of goods and services;
b) Protection of health and physical safety;
c) Training and consumer education;
d) Consumer information;
e) Protection of economic interests;
f) The prevention and reparation of patrimonial or non-patrimonial damage resulting from the offense of homogeneous, collective or diffuse individual interests or rights;
g) Legal protection and accessible and prompt justice;
h) To participate, by representative means, in the legal or administrative definition of their rights and interests.
4. Right of Repentance (article 10 of Decree-Law no. 24/2014, of February 14):
a) The consumer has the right to withdraw from the contract without incurring any costs, and without having to state the reason, within 14 days.
b) The following are excluded from the guarantee expressed in the previous paragraph:
b.1- Shipping costs for returned goods.
b.2- Gold and silver goods and other goods whose price depends on fluctuations in financial market rates which MNM Numis® cannot control and which may occur during the period of free resolution.
5. The catalog has been carefully prepared and the lots are described objectively. The pieces will be sold in the condition in which they were received and displayed. A description of the condition of the piece and any defects or the like will be given as far as possible, but without obligation. Interested parties or their experts are requested to make a prior and detailed examination of the goods of interest up to the day of the Auction.
6. Auctions are strictly in the order of the catalog. Any changes may be made by MNM Numis®.
7. Bids may be placed prior to the auctions and the bidder may authorize the auction organization to bid on their behalf. By bidding in writing and/or authorizing the auction organization to bid on their behalf, the bidder automatically accepts in full the rules and conditions set out in these regulations and cannot claim to be unaware of them in any way.
8. The organizers will provide a free and confidential telephone and Internet bidding service as a CORTICE, without being legally bound by any fault of any kind.
8.1 INTERNET BIDDING: the bidder will be able to place automatic bids, so that if another bidder covers their bid, the system will automatically generate a new bid for that bidder, plus the minimum increment, up to the maximum limit set by the bidder. Automatic bids will be recorded in the system with the date they are placed.
8.2 In the event of a tie between bidders who placed bids on the same lot and for the same amount, the winner will be the bidder who placed the bid first (date and time of registration of the bid on the website), including the fact that the automatic bid is registered on the date it was placed. For tie-breaking purposes, the automatic bid will prevail over the manual bid.
8.3 The bids offered are IRREVOCABLE and UNREPEALABLE. The bidder is responsible for all bids made on their behalf; bids cannot be annulled and/or canceled under any circumstances.
9. MNM NUMIS® reserves the right not to accept bids from bidders with outstanding obligations or a history of payment delays and difficulties.
10. BIDS will always be in national currency - Euro.
In the event of a dispute during the auction, the Auctioneer's word shall prevail.
12. Lots purchased must be paid for in cash and removed within 72 hours of the end of the auction; the Auctioneer's commission will be added to the value of the bids, amounting to 5% of the total bids. VAT at the legal rate is added to the Auctioneer's Commission.
13. In the event of non-compliance with payment, the auctioneer may cancel the sale and charge her commission (5%).
14. Pick-up of lots must be scheduled. The lots can only be delivered after payment of the total purchase price. Our delivery method is pick-up at the location specified by the auction. For buyers who are unable to pick up their lots at the specified location, we may, as a courtesy, provide packaging and transportation, passing on these costs to the bidder. As this is a mere courtesy, the auctioneer and the organization disclaim any responsibility or liability for possible damage, loss and/or other risks related to transport.
15. We ship worldwide. Shipping costs, whether to the national territory, EU area or the rest of the world, will always be made according to the CTT table, and the winning bidder may opt for another postal/courrier service, bearing the shipping costs in any case.
16. Any dispute relating to this auction is subject to Portuguese law and the jurisdiction of the Lisbon District Court.
